Les autorit\u00e9s allemandes expliquaient que la d\u00e9cision avait \u00e9t\u00e9 valablement signifi\u00e9e puisque affich\u00e9e pendant deux semaines au tribunal. D\u00e8s lors aucun recours n&rsquo;\u00e9tait possible contre la d\u00e9cision prononc\u00e9 in abstentia.<\/p><p>C&rsquo;est sur ce fondement que la Chambre de l&rsquo;instruction de la Cour d&rsquo;appel d&rsquo;Aix-en-Provence a refus\u00e9 sa remise.
